December 19, 2014: I just received a positive decision in a traverse hearing. The decision contains useful language and citations to the effect that an affidavit of service that contains unexplained errors “is not entitled to its usual status as prima facie proof”. In this case, the process server described the premises in his affidavit as a place of business when it was an apartment. This was a medical debt case in which our client was sued for six figures re medical care provided to the client’s disabled son after Westchester Medical Center botched its insurance application.
